Decision ruling tax credit unconstitutional is appealed.

The state has appealed a decision from a federal appeals court which it described as a crippling blow to the power to lure business to Ohio. The 6th Circuit Court of Appeals ruled unconstitutional a state corporate franchise tax credit for companies that buy new manufacturing machinery. Department of Development director Bruce Johnson says the appeal was filed Thursday, and he expects a stay to be issued, so the decision against the tax credit won’t take effect for now. The decision comes from a case involving some homeowners and businessowners near the DaimlerChrysler plant in Toledo, which was hoping to use the tax credit to expand the plant. The group claimed the credit was illegal because it discriminates against interstate commerce by encouraging investment in Ohio at the expense of other states – essentially, pitting states against each other.
