Can someone sue for damages over the fear of developing a deadly disease?.

The Ohio Supreme Court will hear arguments in an emotional case Tuesday. At issue is whether a family can sue a hospital for emotional distress because of a FEAR of developing HIV/AIDS. William Mikesell represents the Akron parents who brought their 5 year old daughter to Meridia Southpointe Hospital in suburban Cleveland after she hit her head during a fall three years ago. Mikesell says she took off her shoes to take a balance test, and stepped on a needle lying on the floor. Since the girl's HIV tests have all come back negative, the case was thrown out of court. The attorney who will argue for the hospital refused to comment on the case, but cites a previous decision that says emotional distress claims can't be based on a danger that exists only in a person's mind.
